Areas of Practice-

Personal Injury Defense -Lomurro, Davison, Eastman and Muñoz represents numerous clients in many different types of Personal Injury Defense matters in Federal and State Courthouses throughout the State of New Jersey. We aggressively defend personal injury lawsuits in a cost-effective manner remaining fully responsive to the client at all times.
Our practice includes the defense of motor vehicle accident personal injury claims. We also serve various public entities and municipalities in the defense of a wide variety of tort claims and civil rights litigation.
The firm's practice also includes the representation of clients in the defense of work place accidents occurring in various industrial and other employment settings. These claims, which may range from wrongful death actions to soft-tissue injuries, require experienced personal injury litigators.
We defend general liability claims in many different contexts, including premises liability, and stress meticulous and vigorous preparation by our attorneys to ensure client satisfaction with the handling of each individual claim and suit. For example, we give full consideration to certain tactical advantages provided by the Offer of Judgment Rule and the New Jersey Frivolous Lawsuit Statute in those cases where such aggessive defense tactics are warranted by the facts. We regularly communicate with our clients to achieve their goal of obtaining cost-efficient, quality legal services with a heavy dose of common sense.

Product Liability Defense- Product Liability cases require attention to detail, seasoned experience, and a complete understanding and familiarity with the complex aspects of the law that relate to a cause of action based upon an allegedly defective product. The firm has experienced trial attorneys handling its product liability matters encompassing many different types of industrial and consumer products.
Our experience includes the defense of product liability actions on behalf of motor vehicle manufacturers, food and beverage companies, as well as manufacturers of various industrial products and chemicals. Moreover, our experience includes defending claims made pursuant to New Jersey Product Liability Act and consumer fraud theories.
We have defended companies in multi-plaintiff asbestos, silica and chemical exposure cases. These cases may also involve many defendants, where experienced defense counsel facilitates effective and efficient representation.

Our experience includes representation of clients in matters involving the following types of claims: alleged design malpractice, negligent workmanship, construction delays including critical path method (CPM) analysis, non-payment, scope of work/change order issues, termination and bid disputes.
Clients must be extremely cost-conscious in this competitive field. Litigation costs can be damaging to all parties. We have extensive experience with numerous alternative avenues of resolving disputes, including arbitration (binding and non-binding), mediation, and mini-trial procedures.

Criminal Law - State & Federal
It is an unfortunate reality that our clients and their families or friends may find themselves with a criminal problem. Often clients are unaware of the enormous consequences that today's society places on violations of our criminal law. State and federal criminal statutes provide for mandatory jail time and complex sentencing guidelines that direct judges toward longer prison terms than ever before. Convictions can also result in fines, forfeiture of assets and the loss or debarment from employment and participation in government programs. In that time, when clients are least prepared for such a situation; they can be assured that this firm is equipped to immediately respond.
Donald M. Lomurro has been engaged in the practice of criminal defense law over 25 years and has defended numerous clients facing charges ranging from murder to drug possession. He is designated by the New Jersey Supreme Court as a Certified Criminal Trial Attorney, and has served as the Chairman of the Certified Trial Attorney Section of the New Jersey State Bar Association. Jonathan H. Lomurro and Carrie A. Lumi round out the criminal defense team with experience in juvenile delinquency and municipal criminal matters as well as criminal appeals.

Estate Planning- TAX PLANNING
WILLS
TRUSTS
LIVING TRUSTS
DURABLE POWER OF ATTORNEY
ELDER LAW
BUSINESS SUCCESSION PLANS
ESTATE ADMINISTRATION
PROBATE MATTERS
GUARDIANSHIP
Robert F. Muñoz has earned his U.M. (Masters in Tax Law) from New York University and is a member of the National Academy of Elder Law Attorneys.
Being mindful of man's mortality, clients seek the firm's advice regarding Estate Planning, Taxes, Wills, Trusts, Living Wills, Durable Power of Attorney, Living Trusts, Business Succession Plans and the settling of their worldly estates.
Estate Planning is one of the best examples of our ability to humanize and simplify an important planning process. All too many people ignore this important measure because they think it is too complicated or only meant for the very rich. In truth, everyone should be planning for the administration and protection of their assets, during their lifetime as well as the direction and disposition of their personal and business assets upon their death.
Indeed, while we simplify the Estate Planning process, you should be conscious of the fact that the process is not simple! Our experience and knowledge of the many considerations of prudent Estate Planning combined with our Tax expertise permits us to lead our clients safely through the many pitfalls of Estate and Tax Planning as well as Estate Administration.

DWI Defense- Driving while intoxicated defense and reform are a focus of our practice. Our office provides the highest level of representation for defendants charged with DWI. We also work to reform unduly harsh and punitive DWI law and procedures.
DWI is a serious offense in New Jersey. The Court, must impose significant license suspensions, fines, surcharges, intoxicated Driver Resource Center participation and in certain cases, jail and community service. The Division of Motor Vehicles must also impose a mandatory insurance surcharge from $3,000 to $3,500. Frequently, automobile insurance is also canceled which can only be repurchased at the highest rates. A permanent record of the DWI conviction is also entered onto the Drivers Abstract maintained by the New Jersey Division of Motor Vehicles. No "work license" is available during the period of suspension and penalties for operation while suspended for DWI require mandatory jail and additional license suspension. Penalties differ depending upon whether the offense is a first, second or subsequent offense.
We defend DWI charges everyday in Courts throughout the State of New Jersey. Our philosophy is that you cannot win a DWI case unless you try to win. For this reason, we try almost all of our cases to a verdict unless a better result can be achieved without trial. We make the State prove its case both in trial and in pre-trial suppression motions. We search for all possible evidence which might make the difference in winning a case. We vigorously cross-examine police officers regarding field sobriety tests and observations claimed to suggest intoxication. We work regularly with the top DWI experts in the State of New Jersey, who can attack breath test results and field sobriety test results when these tests have not been correctly administered.

Municipal Court Defense- DRIVING WITH SUSPENDED/REVOKED LICENSE
MOVING VIOLATIONS
DRUG OFFENSES
DISORDERLY PERSON OFFENSES
UNDERAGE DRINKING/POSSESSION OF ALCOHOL
MARIJUANA OFFENSES
Often, the first experience individuals have with the New Jersey justice system is in municipal court. Our firm provides quality and experienced representation in municipal courts throughout the State of New Jersey. Whether our client is charged with a serious violation, such as driving while suspended, or a traffic offense that will add points to your license, we vigorously defend your rights.
Although municipal court is sometimes referred to as "traffic court," criminal matters are also heard in the municipal courts. Charges ranging from possession of drugs, simple assault, harassment and neighborhood disputes are also addressed in municipal courts. Our lawyers have served not only as defense counsel, but also as municipal prosecutors in various municipalities. This level of experience assures a superior quality of representation and gives our clients a level of comfort throughout the process.

Appeals- An appeal is the process by which a lower court decision is reviewed by a higher court. It is a legal argument that calls upon the higher court to determine whether the lower court erred in its application and interpretation of the law. A higher court will also examine whether the judgment of the lower court was proper in light of the evidence presented at trial. No new evidence is admitted in an appeal unless there are exceptional circumstances.
Whether it is a civil or criminal matter, our attorneys are experienced in both initiating and appeals and defending against those brought by other parties. We invite and welcome your inquiries.
